Terms of Sale
Effective Date: August 26, 2026 · Official English Version
These Terms of Sale (“Terms”) govern purchases made through vip-selection.tokyo or through a Stripe checkout page linked from that Site for delivery to any of the 50 United States.
By placing an order, you confirm that you have read and agree to these Terms and our Returns, Refunds & Shipping Policy. If you do not agree, do not place an order.
1. Scope and Incorporated Documents
These Terms apply to orders placed on or after the Effective Date. The agreement for each order includes these Terms; the applicable product description and disclosures displayed at purchase; the price, currency, quantity, delivery address, and other order-specific information displayed at checkout; any order-specific term expressly accepted by the customer; and our Returns, Refunds & Shipping Policy (the “Returns Policy”), which is incorporated into these Terms.
The Returns Policy controls matters concerning dispatch, shipping delay, pre-shipment cancellation, delivery problems, returns, return shipping, refunds, incorrect addresses, refused delivery, and customs clearance. These Terms control other sales matters. Mandatory applicable law controls over both.
A “business day” means Monday through Friday, excluding national public holidays in Japan. The version presented or linked at purchase applies to that order; a later change will not retroactively reduce a customer's rights.
2. Seller Information
Pachi Pachi Inc.N&E BLD. 7F
1-12-4 Ginza, Chuo-ku
Tokyo, Japan
Email: contact@vip-selection.tokyo
Stripe acts as our payment processor. Pachi Pachi Inc. remains the seller responsible for order fulfillment, returns, and refunds.
3. Customer Eligibility and Lawful Purchase
You may place an order only if you are at least 18 years old, have legal capacity to enter a binding contract under the law applicable to you, and may lawfully purchase, receive, possess, and use the product at the delivery address. If applicable law imposes a higher product-specific minimum age, you must meet it. These requirements also apply to any intended recipient.
Our products are extremely sharp kitchen knives intended for lawful culinary use and can cause serious injury if handled or stored improperly. The customer must use, transport, and store the product safely, keep it away from children and unauthorized persons, and comply with applicable federal, state, and local laws.
We may request information reasonably necessary to confirm age, identity, delivery eligibility, or legal compliance. We may decline or, before carrier handoff, cancel an order where reasonably necessary to comply with applicable law or carrier restrictions and will promptly refund any captured payment in full. Nothing in this Section transfers to the customer a legal duty that applicable law places on us.
4. Product Information and Handmade Variations
We seek to describe and display each product accurately. Each knife is handmade or individually finished, so minor, non-material variations in pattern, color, texture, finish, dimensions, weight, or other artisanal characteristics may occur within any tolerances disclosed on the product page. Screen settings, lighting, and photography can also cause minor differences in apparent color or finish.
Photographs and specifications identified as depicting the actual one-of-a-kind item form part of that item's description. This Section does not excuse an incorrect item, a latent or material defect existing at delivery, or a material departure from the product description. We will not substitute another item without the customer's affirmative agreement.
5. Prices, Taxes, and Payment
Prices and the transaction currency are shown at checkout. By completing checkout, the customer authorizes the submitted payment method to be charged for the total shown and represents that the customer is authorized to use it.
The checkout page displays amounts collected by us, including any sales tax or other charge that applicable law requires us to collect. Import duties and destination charges are addressed separately in Section 6.
Stripe processes payment under its applicable terms and privacy notices. Refunds are initiated to the original payment method in accordance with the Returns Policy. A payment authorization, payment capture, automated receipt, or automated order acknowledgment does not, by itself, constitute our acceptance of an order.
6. Delivery and Import Charges
Unless checkout expressly states otherwise, delivery is DAP (the complete delivery address stated in the order), Incoterms® 2020. We arrange and pay for standard outbound carriage and bear the risk of loss of or damage to the goods until they are placed at the recipient's disposal on the arriving means of transport, ready for unloading, at that address, subject to the buyer-risk provisions of DAP.
The buyer or recipient is responsible for import clearance and for applicable import duties, import taxes, customs-clearance charges, brokerage fees, and other governmental or customs-related destination charges not expressly included at checkout, except for amounts applicable law requires us to collect or pay. “Free shipping” refers only to the standard outbound carriage charge.
An estimate of an import charge not collected at checkout is informational only; the final amount is determined by the relevant authority, carrier, or customs broker. This cost allocation does not make the customer responsible for loss or damage occurring before delivery or limit a non-waivable right.
7. Orders, Availability, and Acceptance
Submitting an order is an offer to purchase. An automated checkout, payment, receipt, or acknowledgment message confirms receipt only. We accept the order when we send a separate notice expressly confirming acceptance or physically place the item in the carrier's possession, whichever occurs first.
Before acceptance, we may decline an order for a legitimate reason, including unavailability or a simultaneous sale of a one-of-a-kind item, failed payment or fraud verification, incomplete or undeliverable address information, an applicable legal or carrier restriction, inability to fulfill as described, or an obvious and material listing or pricing error.
We will not increase the price or substitute another item without the customer's affirmative agreement. If we decline an order after capturing payment, we will promptly initiate a full refund to the original payment method and no later than seven business days, unless applicable law requires an earlier refund.
Regardless of acceptance, the customer may cancel before physical carrier handoff as provided in the Returns Policy. The acceptance process does not restart or extend the dispatch period in Section 8.
8. Dispatch, Delivery, and Delay
We will physically place the order in the carrier's possession within five business days after receiving full payment and complete and accurate shipping information reasonably required to fulfill it.
This period concerns dispatch from Tokyo, not delivery. Carrier transit and customs-clearance time begin after dispatch. A carrier delivery date is an estimate unless expressly stated to be guaranteed.
If we cannot dispatch within the stated period, we will provide the notice, revised dispatch information, delay-consent option, cancellation option, and refund required by the Returns Policy and applicable law. Loss or damage before delivery is also handled under the Returns Policy.
9. Cancellation Before Carrier Handoff
A cancellation request is effective without charge if it reaches contact@vip-selection.tokyo before the item is physically placed in the carrier's possession. Creating a shipping label is not carrier handoff.
Email immediately with the subject line CANCELLATION — [ORDER NUMBER] and include the purchaser's name and email address. For a valid cancellation, we will initiate a full refund to the original payment method promptly and no later than seven business days after receipt. After carrier handoff, voluntary cancellation is unavailable, subject to the Returns Policy and non-waivable rights.
10. Returns, Delivery Problems, and Refunds
After physical carrier handoff, all sales are final for change-of-mind purposes only. This rule does not apply to transit loss, an item that arrives damaged or incorrect, missing contents, a material defect, a material difference from the product description, or any right or remedy that cannot lawfully be waived.
The Returns Policy governs reporting, evidence, inspection, return authorization, return shipping, refund amount, method, and timing. Do not send an item back without written authorization. We have no U.S. return facility. If an approved physical return is required for a claim for which we are responsible, we will arrange or pay for the approved trackable, fully insured return to Japan.
Where applicable law allows us to choose a remedy, we prefer a refund to the original payment method. We will not substitute a replacement without the customer's agreement. No restocking fee applies to an approved claim for which we are responsible.
11. Delivery Information, Refused Delivery, and Customs Cooperation
The customer must provide complete and accurate delivery information and cooperate promptly with the carrier and customs authorities. Refusing delivery, failing to complete customs clearance or pay properly disclosed import charges, or providing an incorrect or incomplete address does not create a change-of-mind cancellation or return right.
If a parcel is returned solely for one of those reasons, reshipment and refund options, and any deduction of actual, documented, nonrecoverable third-party charges permitted by law, are governed by the Returns Policy. We do not impose an internal handling or restocking fee. This Section does not apply where the problem results from our error, a nonconforming item, transit damage, a qualifying defect, shipping delay, or a right under applicable law.
12. Intellectual Property
The Site and its text, photographs, images, logos, trademarks, layout, and other content are owned by or licensed to Pachi Pachi Inc. or the applicable rights holder and are protected by applicable intellectual-property law.
Purchase of a physical product does not transfer intellectual-property rights in the Site, brand, product photographs, written content, packaging artwork, or trademarks, except for rights necessarily associated with lawful ownership and use of the physical product. Nothing here restricts a use permitted by applicable law.
13. No Separate Voluntary Durability Guarantee
We do not make a separate voluntary promise concerning the future service life or durability of the product. This does not characterize, exclude, restrict, or modify any express or implied warranty, statutory right, product-liability claim, or remedy arising under applicable law.
14. Non-Waivable Rights and Responsibility
Consumer rights and remedies may vary by state. Nothing in these Terms excludes, restricts, or modifies a right, remedy, warranty, or liability that cannot lawfully be excluded, restricted, or modified under applicable federal, state, or local law. If applicable law is more protective, that law controls to the extent of the conflict.
Nothing in these Terms is intended to exclude or restrict liability for fraud, willful misconduct, gross negligence, personal injury, or product liability to the extent such liability cannot lawfully be excluded or restricted.
15. Electronic Communications
The customer agrees that we may send transactional communications concerning an order by email, including payment, order, age or address verification, cancellation, dispatch, delay, customs, delivery, claim, return, and refund communications. This does not constitute consent to receive marketing communications.
The customer must provide an accessible email address and promptly notify us of any correction before carrier handoff.
16. Changes, Severability, and No Waiver
We may update these Terms for future orders. The version presented or linked when an order is placed governs that order.
If a provision is found invalid or unenforceable, it will be limited or separated only to the minimum extent necessary, and the remaining provisions continue to apply to the extent permitted by law. A failure or delay in enforcing a provision does not, by itself, waive it or any later right.
17. Entire Sales Agreement
Subject to applicable law, these Terms, the Returns Policy, the applicable product description, checkout information, and any order-specific term expressly agreed by the parties constitute the sales agreement for the order.
An order-specific provision expressly agreed by both parties controls over a conflicting general provision. The Returns Policy controls matters within its stated scope. Nothing here excludes liability for fraud or misrepresentation or limits a right that cannot be waived.
18. Contact, Written Copy, and Official Language
Questions should be sent to contact@vip-selection.tokyo. Our mailing address is N&E BLD. 7F, 1-12-4 Ginza, Chuo-ku, Tokyo, Japan. A written copy of these Terms is available by email request.
